Types of Power of Attorneys
Durable Power of Attorney
A Durable Power of Attorney (Financial) allows the appointed agent to make legal and business decisions on a principal’s behalf should the principal become disabled, incapacitated, or unable to handle these matters themselves. Some of those business and legal duties include selling properties, managing assets, filing taxes, conducting business, collecting government benefits, signing contracts and etc. It is important to choose a trusted individual to act on your behalf; a Durable Power of Attorney remains effective until it is legally revoked or the principal dies.
Medical Power of Attorney
A Medical Power of Attorney allows an agent to make healthcare decisions on the principal’s behalf should they become incapacitated or unconscious. Having a trusted individual agree to act as your agent allows your life to go as planned although you are insensible. The appointed agent would be allowed to decide on medical treatment options, end-of-life care, personal care management, and etc.
Power of Attorney Revocation
A Power of Attorney Revocation legally voids the powers of the principal’s agent in the Power of Attorney. In many circumstances, it is the principal that typically initiates the process of a revocation. Common reasons for revoking a Power of Attorney include, an agent not acting in the principal’s best interests; and/or the agent no longer wishes to service the principal. In some states a verbal revocation will suffice; in others, a Power of Attorney Revocation document must be completed. Once the principal signs the legal revocation, the Power of Attorney will be instantly voided.
Spring Power of Attorney
Like a Durable Power of Attorney or General Power of Attorney, a Springing Power of Attorney allows the agent to make financial and medical decisions on behalf of the principal. However, unlike a Durable or General Power of Attorney, a Springing Power of Attorney comes into effect when certain conditions are met. This Power of Attorney only becomes effective when the principal becomes incapacitated.
Special Power of Attorney
A Special Power of Attorney allows a principal to appoint an agent to handle a few (one or two) transactions or financial matters for a limited of time.
