Can You Notarize A Document If The Person Is Not Present In NY?
The answer to the question above depends on how the Notary conducts business and/or the individual needing notary service willingness and ability to participate. For Notary Glow, the answer is yes. Notary Glow has the ability to notarize a person’s document(s) if they are not physically located in New York. As long as the individual requesting the notarial act is willing to appear on camera in the presence of our notary, we can notarize that person’s document(s); this notarization or notarial act, is called a Remote Online Notarization. Some states in the U.S. have given the notary publics in their state, permission to conduct remote online notarizations. As of February 25, 2022, the state of New York has granted its commissioned notaries the permission to conduct remote online notarizations if they wish. A little secret… all states throughout the United States do recognize and accept remote online notarizations.
Although an individual can personally get their document(s) notarized through the process of remote online notarization, they cannot have their document(s) notarized just by sending them to the notary. If the person (principal) requesting the notarization is not present in New York and will not participate in a remote online notarization, the document can only be notarized using a Subscribing Witness. In this situation, the notary public would direct a third party (the subscribing witness) to witness the person (principal) requesting the notarization, sign the document; then, that subscribing witness would bring the signed document to the notary for a proof of execution. The witness signs (subscribes) on the same document in the principal’s presence and takes an oath or affirmation, pledging truthfulness, from the notary. The witness should be personally known to the Notary Public or be able to provide satisfactory evidence that they are the same person as the actual subscribing witness. In the state of New York, a proof of execution by a subscribing witness is a legally acceptable substitute for an acknowledgement by the principal signer.
For a hassle-free and easier experience, we recommend going the remote online notary route. Notary Glow offers remote online notary service in just a few clicks. In less than 15 minutes you can have your important document(s) notarized and ready to serve your next purpose.
Remote Online Notarization - What is it?
You might ask, “What is a Remote Online Notarization?”, and that would be a very valid question; most people are unfamiliar with that concept of notarization. Remote Online Notarization is when a notarial act is conducted over the internet without the requester appearing physically in the Notary Public’s presence. It’s like receiving notary services using Skype, FaceTime, or Zoom with the help of Adobe Acrobat Pro. Remote online notary services have been around for a minute now; however, it is not an entirely new concept. The State of Virginia is the pioneer of the modern Remote Online Notarization system. Virginia was the first state to set laws for online notarization practices and the notaries for the state of Virginia set up the framework for how many remote notary platforms operate. The Covid-19 pandemic is responsible for the rise in popularity of remote online notarizations. As a result of the lockdown restrictions, many states in the U.S. have adopted permanent and/or temporary laws for conducting remote online notarial acts. Those newly issued state laws, temporary or permanent, makes accepting a document notarized online, a legal and valid practice throughout the United States; and all states will accept these documents.
